  • Implementace požadavků kybernetické bezpečnosti do specifického prostředí lokální sítě veřejné správy

    Práce řeší formou projektu implementaci bezpečnostních pravidel dle požadavků zákona č. 181/2014 Sb., o kybernetické bezpečnost do lokální sítě městského úřadu obce Kroměříž. Bezpečnostní procesy by měly být nastaveny v souladu s legislativou a bezpečnostními standardy, jako je například řada ISO/IEC 27k. Stanovování cílů v této oblasti se přitom musí odvíjet od cílů celé organizace, a proto je nutné v případě subjektů veřejné správy a zdravotnictví uvažovat jejich specifické aspekty.

  • Le droit de la consommation dans l'économie numérique : étude des déséquilibres de l'internet

    L'objet de cette thèse est de pointer les difficultés rencontrées par le droit de la consommation lorsqu'il est confronté aux déséquilibres nés de l'usage des technologies de l'information, et de proposer des solutions cohérentes juridiquement et rationnelles sur le plan économique. Les terminaux connectés à l'internet deviennent de plus en plus nombreux. Le consommateur est amené à conclure régulièrement des contrats souvent très denses, aux enjeux difficiles à appréhender et presque systématiquement à dimension internationale. La matière de cette thèse est composée de tous les contrats conclus par le biais de l'internet à partir d'un terminal connecté, dont l'objet est une exécution totalement dématérialisée via les technologies de l'information. Ceci constitue l'économie numérique. Par le biais notamment de la règlementation relative aux clauses abusives, cette thèse s'intéressera particulièrement au sort des données à caractère personnel, à la géolocalisation, aux contenus protégés par la propriété intellectuelle et aux nombreuses restrictions d'utilisation dont ils font l'objet. Au travers de cette thèse, les insuffisances des différents corps de règles applicables aux contenus numériques (protection des données à caractère personnel, droit de la propriété intellectuelle, droit de la consommation) seront mises en évidence. Plusieurs propositions et synthèses seront envisagées au sein de cette thèse afin de remédier au mieux aux déséquilibres propres de l'économie numérique.
  • El cyber-bullying y la violencia de género

    In this paper, we try to analyze the response of the various existing provisions in the Criminal Code against gender violence produced by cyberbullying. We do it by reviewing the literature and analyzing the Criminal Code where we notice a lack of proportionality in relation to the facts involved in the crime, id est, degrading treatment, libel, slander, disclosure of secrets, threats and inducement to suicide in crimes of violence of gender. This happens because there is no specific criminal provision to regulate and criminalize illicit actions derived from this type of attacks on the fundamental rights of the victim on the Internet. The speed of communication, file sharing, messaging and viral effect, for example, linked to the nature of the Internet, have as a result that information can be shared by all Internet users. This introduces an aggravating factor in the crime committed which is not punishable under the current Criminal Code. Therefore, we try to prove that introducing a crime specifically focused on those types of illegal behavior that take place in the Internet would be advisable, either through an aggravating circumstance in the penal provision itself, or through a new penal provision as has been done in the case of the crimes “ex novo” sexting and stalking. The structure of this paper comprises three sections: In the first section we approach the problem. In the second section, we reflect on the concept and traits of cyberbullying. In the third section, we go through the legal and judicial response given by the Criminal Code to this type of criminal offenses.
