  • Data protection in cloud computing - The Swedish perspective

    This article describes and analyses three recent decisions by the Swedish Data Inspection Board (Datainspektionen) directly focused on cloud computing. All three decisions were published on 28 September 2011 as part of a supervisory project seeking to clarify what demands the Data Protection Act places on organisations utilising cloud computing. As such, and due to the fact that similar concerns arise in the three matters, there is considerable overlap between the three decisions. Indeed, large parts of text are identical in the three decisions. To avoid repetition, I discuss the first decision in most detail, and limit the discussion of overlapping issues in the context of the other two decisions.

  • La necesaria adaptación de los tributos a las nuevas tendencias de los negocios electrónicos

    <p>Los nuevos modelos de negocio digitales, así como la complejidad de algunas operaciones de comercio electrónico, encuentran en la red el nicho idóneo para la derivación de los beneficios hacia territorios en los que existe una menor o nula tributación, y también la forma de incumplir, en ocasiones, con las obligaciones tributarias. Ello dificulta enormemente la fiscalización de este tipo de operaciones, así como el control del fraude por las administraciones tributarias. La rápida evolución de las nuevas tecnologías pone en evidencia muchas veces a los legisladores, que, en ocasiones, se quedan desfasados con respecto a las complejas operaciones que surgen casi a diario en el mundo virtual, y obliga a las administraciones a un ejercicio continuo de actualización y adaptación de las normas para ajustarse a la nueva realidad que trae consigo la economía digital.</p>
  • Beyond Abstraction, the Law and Economics of Copyright Scope and Doctrinal Efficiency

    Uncertainty as to the optimum extent of protection has generally limited the capacity of law and economics to translate economic theory into coherent doctrinal recommendations in the realm of copyright. This article explores the relationship between copyright scope, doctrinal efficiency and welfare from a theoretical perspective to develop a framework for evaluating specific doctrinal recommendations in copyright law. The usefulness of applying this framework in either rejecting or improving doctrinal recommendations is illustrated with reference to the predominant law and economics theories of fair use.
