Abstract
"A proposta deste artigo é fazer uma breve análise a respeito da posição ocupada por animais em uma ordem jurídica. Busca-se compreender, para tanto, o conceito de pessoa para o direito, diante de um momento de crise das categorias tradicionais do pensamento jurídico e de desafios da sociedade moderna. Seguindo a lógica especista que rege o raciocínio humano e uma visão antropocêntrica, não houve espaço, até então, para que a ideia de reconhecimento fosse trabalhada entre espécies diferentes. É feita análise, portanto, se deveriam os animais ser tratados pela sociedade e pelo ordenamento jurídico como coisas. Em seguida, investiga-se acerca da possibilidade e bases para personificação. Apesar das atuais tentativas de atribuir o status de pessoa aos animais, essa questão perpassa por obstáculos teóricos e práticos delicados que devem ser repensados. Acredita-se que a abordagem do problema a partir da ideia de antropodecentramento proposta por Marchesini (2009) possa elucidar alguns desses problemas" ["This article intends to make a brief analysis of the position nowadays occupied by animals on a legal order. We aim to understand, for that matter, the concept of "person" before the Law, on a moment of crisis of the traditional categories of juridical thought due to the challenges of modern society. Following the speciesist logic that guides human reasoning and an anthropocentric approach, there has been no room, until now, for the development of the idea of recognition among different species. The starting point is analyzing if animals should be seen by society and legal order as goods. Afterwards, investigating the possibilities and basis for personification. One can see some attempts of conceding the status of person to animals, but this discussion runs through delicate theorical and practical obstacles that must be reconsidered. It is believed that an approach on the problem from the idea of anthropodecentrism offered by Marchesini may elucidate some of these issues"]
