Abstract
"Son diversas las cuestiones que se encuentran involucradas en la regulación positiva del DPI. De entre todas ellas, el artículo se centra en el sujeto que se somete al diagnóstico. En primer lugar se analiza su estatuto biológico. Este estudio inicial permite deducir que la identidad y el desarrollo biológico del ser humano se producen de forma ininterrumpida y progresiva desde la concepción, independientemente de si ésta ha tenido lugar in vivo o in vitro. En segundo lugar se analiza cuál es la protección jurídica que le brinda el ordenamiento jurídico español. Este estudio evidencia que la Ley española sobre técnicas de reproducción asistida refleja una infravaloración de la vida humana embrionaria. Infravaloración que en los primeros estadios de vida se traduce en una ausencia total de protección legal. Por último, se hace una breve reflexión en torno a la idea de calidad de vida, dada su estrecha vinculación con la práctica del diagnóstico. Y esto porque el recurso a la selección de embriones in vitro por medio de DPI se justifica amparándose en que los desechados no alcanzan un mínimo de salud exigible. La conclusión final es que la desprotección jurídica al débil que manifiesta nuestra normativa sólo conduce a una deshumanización del Derecho, o, lo que es lo mismo, a la pérdida de su razón de ser".
