Abstract
This study will discuss three formulations of the problem. First is to try to see the skill gap for the wife to refuse reconciliation. Second is to seek reconciliation permissibility within gender perspective. And third is to try to build a gender-based paradigm of ushul fiqh that can reconstruct the articles in the Compilation of Islamic Law. This study concludes that first, there is a benefit rule used by the modern Indonesian Ulama in giving crack to reject reconciliation in articles Marriage Law in the Compilation of Islamic Law. Second, by using scholars view such as Thufi’s theory in understanding the context of the problem of rejection refers to the husband. Third, building a paradigm-based Compilation of Islamic Law Islamic Gender ushul in building friendly compilation of Islamic law against women.
