Abstract
The paper explore the long history of Islamic constitution context recognizing at least three functiosn and agencies of state power, which are: the and the judicial power (sulthah qadha` iyah). This Islamic conception had gotten some changes during Umar Bin Khatabb and Umar Bin Abdul Aziz's leadership especially related to judicial power. Finally the author suggests that the example from Islamic context also possible and relevant to be applied into Indonesian situation
