Abstract
"The quality of the nation’s waters depends on the ability to regulate the introduction and movement of pollutants to those waters. In 2008, the Environmental Protection Agency (EPA) adopted the National Pollutant Discharge Elimination System (NPDES) Water Transfers Rule, which allows the introduction of pollutants from one body of water to another without a permit.1 The Eleventh Circuit recently reviewed the validity of the new rule as applied to polluted agricultural runoff being pumped into Lake Okeechobee."
