Abstract
经济和社会权利被《世界人权宣言》和国际人权公约宣布为是一种“人权”，但问题是，传统的 人权和权利理论可以包容这种权利类型吗？为了回答这个问题，我们既需要对经济和社会权利 的人权和权利性质进行一番审视，也需要对人权和权利的概念本身进行必要的反思。
