Abstract
"O trabalho pretende verificar os critérios de tomada de decisão tanto em Richard Posner, quanto em Duncan Kennedy. A partir dessa verificação dos critérios, pretende encontrar elementos que indicam, tanto no plano positivo, quanto no plano normativo (quando possível), notas que levam à defesa ou à admissão de um juiz parcial. A questão que se pretende responder nesse trabalho é, se nessas teorias funcionalistas, que se afastam de uma pretensão de conferir autonomia ao Direito, os juiz são ou devem ser parciais" ["This paper aims to verify the criteria for decision making in both Richard Posner, as Duncan Kennedy. From this verification criteria, it wants to find elements that indicate both - the positive level, as the normative level (when possible) - notes that lead to the admission or a defense of a partial judge.
