Abstract
This paper explores the important of building an epistemological ijtihad in the field of medical jurisprudence through contextualization of Maqasid al-Syari'ah (Purposes of Islamic Law). The author shows that the approach of Maqasid al-Syari'ah is an approach in finding Islamic law by integrating between texts and contexts, texts and intellect. Some instruments in Maqasid al-Syari’ah approach used as epistemology of health fiqh are Istihsan (Judicial Preference), Fath al-Dzara'i' (Opening the means), 'Urf (Customs), and Istihsab (Pre-assumption of Continuity).
