Abstract
"Este trabajo busca contribuir a la necesidad de propiciar la obtención de estándares legislativos o procedimentales comunes mínimos que garanticen la necesaria cooperación científica y el acceso a recursos comunitarios sin discriminación motivada por una legislación estatal más o menos restrictiva en lo que se refiere a la investigación y la experimentación científicas con embriones humanos para el estudio de las células troncales. Luego de apuntar las carencias de los marcos legales internacionales que regulan la protección del embrión in vitro, la materia es analizada en el contexto de la Unión Europea, profundizando y detallando lo dispuesto en el Convenio sobre Derechos Humanos y Biomedicina (CDHB), que constituirá, al final, el núcleo para un estatuto jurídico del embrión in vitro como punto de partida para una confluencia de los Estados europeos. A partir de ahí surgen las propuestas para una armonización de las legislaciones estatales europeas sobre la investigación con células troncales embrionarias, con las que se concluye el presente trabajo" ["The present study attempts to contribute for the need of construction of the minimal common legal statement or process that would warrantee the necessary scientific cooperation and the access to communitarian resources without prejudice motivated by a public legislation somewhat restrictive in what refers to the scientific investigation and research with human embryos for the study of stem cells. Setting the lacks on the international legal statements that regulates the protection for embryos in vitro, this question is analyzed under the European Union context, deeply detailing what is set out in the Convention of Human Rights and Biomedicine (CHRB), what will construct, in the end, the legal statute for the in vitro embryo as the starting point for the European states confluence in what concerns this subject. From this point on, proposals for the harmonization of the European embryo stem cell research public legislations will emerge, including the ones brought by the present study"]
