Abstract
This paper focuses on the configuration of an interpretative analysis of theconscientious objector to euthanasia according the socio-cultural and bio-juridicalcontexts in Colombia. That is, there is an effort to answer the question: How canthe conscientious objection to euthanasia be configured in the Colombian context?In the situations in with the subject pleads conscientious objector to euthanasiaare a dilemma and a delicate issue to handle in the Colombian context, due to thefact that they come up to try to work out conjectural situations from the nationalconstitution of 1991, and not as a felt consensus of the majority. In the ethicalpoliticaland historical-cultural conditions of a fragmented country due to a seriesof uninterrupted wars and violence as a framework for the sentences C-239(constitutional court of Colombia, 1997) and T-970 (constitutional court ofColombia, 2014), the decree 1216, 2015 on a dignified death and sentence C-355(constitutional court of Colombia, 2006) that legalizes abortion in three specificcircumstances. These sentences are only the tip of the iceberg in several ethicalmoralbehaviors (actions and decisions) that are very difficult to solve and requireboth a bio-juridical analysis as well as one from a moral philosophy perspective.
El objetivo del presente trabajo es configurar un análisis interpretativo de la objeción de conciencia a la eutanasia, conforme a los contextos socio-culturales y biojurídicos presentes en Colombia. Es decir, se busca responder ¿cómo configurar el campo objeción de conciencia a la eutanasia en el contexto colombiano? Los casos en los que el sujeto objeta conciencia a la eutanasia representan un dilema de difícil tratamiento en el contexto colombiano, debido a que surgen para solventar situaciones coyunturales del momento, a partir de la Constitución Política de Colombia de 1991, y no como manifestación sentida y consentida por las mayorías. Las condiciones ético-políticas e histórico-culturales de un país fracturado por una sucesión ininterrumpida de guerras y violencias, configuran el marco lógico de las sentencias C-239 (Corte Constitucional de Colombia, 1997) y T-970 (Corte Constitucional de Colombia, 2014), la Resolución 1216 de 2015 sobre muerte digna, y la sentencia C-355 (Corte Constitucional de Colombia, 2006) que despenaliza el aborto en tres circunstancias concretas. Estas sentencias constituyen tan solo la punta del iceberg de una serie de conductas ético-morales (acciones y decisiones) difíciles de resolver que reclaman un análisis tanto biojurídico, como desde la filosofía moral.
