Abstract
The main purpose of this article is to carry out a constructivist analysis of the concept of law regarding two of the most important principles in Kant's political philosophy: the principle of right and the idea of the original contract. The article starts out with a brief presentation of the meaning of Kantian constructivism, and then goes on to analyze the concept of right and of the attributes that define citizenships: freedom, equality, and civil independence. Finally, it examines the Kantian conception of the original contract in order to demonstrate that, according to Kant, there are political duties of both right and virtue.
O propósito central deste artigo é fazer uma análise a partir de uma perspectiva construtivista do conceito de direito de dois dos princípios mais importantes da filosofia política de Kant: o princípio do direito e da ideia do contrato original. O texto começa com uma breve exposição do que significa o construtivismo kantiano. Em seguida, faz-se uma análise do conceito de direito e dos atributos que definem a cidadania: a liberdade, a igualdade e a independência civil. Na última parte, examina-se a concepção kantiana do contrato original e trata-se de mostrar que há, para Kant, deveres políticos tanto de direito quanto de virtude.
El propósito central de este artículo es hacer un análisis desde una perspectiva constructivista del concepto de derecho de dos de los principios más importantes de la filosofía política de Kant: el principio del derecho y la idea del contrato original. El texto comienza con una breve exposición de lo que significa el constructivismo kantiano. A continuación se hace un análisis del concepto de derecho y de los atributos que definen a la ciudadanía, a saber: la libertad, la igualdad y la independencia civil. En la última parte, se examina la concepción kantiana del contrato original y se trata de mostrar que hay, para Kant, deberes políticos tanto de derecho como de virtud.

Export search results
