Abstract
O artigo pretende explorar o pensamentode Charles Taylor, destacando sua antropologia filosófica,sua filosofia política e a sua genealogia do selfocidental, com o objetivo de iluminar alguns aspectosimportantes, mas nem sempre bem-percebidos,da assim chamada repersonalização do direito civil.O argumento central é que a naturalização de certospadrões sociais, bem como de instituições como omercado e o Estado, impedem que sejam percebidasas configurações morais arraigadas tanto individualmentequanto institucionalmente. A opacidade dasfontes morais contribui para fortalecer um sentidoinstrumental e utilitarista da pessoa humana, do qualo discurso da repersonalização do direito civil podenão estar totalmente isento. Para exemplificar o argumentoadentra-se no campo dos direitos de personalidade.Abstract: This article intends to explore CharlesTaylor’s thought, especially his philosophicalanthropology, his political philosophy and hisgenealogy of the western self, in order to pointout some important issues, which are not alwaysnoticed, about the “repersonalization” of privatelaw. The central argument is that the naturalizationof some social standards and of some institutionslike State and market impede to see the moralconfigurations rooted in individual and institutionallevels. The opacity of moral sources contributesto fortify an instrumental and an utilitarianistmeaning of human person, from which the“repersonalization” of private law’s discourse maybe not totally exempt. In order to exemplify theargument, the article goes into personality rightsfield.
