La genèse historique du statut juridique des territoires locaux. Le rôle des trois grandes fonctions

Abstract

L'objectif de cette thèse est de mettre en lumière le rôle des trois grandes fonctions dans la génèse du statut juridique des territoires locaux. La recherche est effectuée à partir du territoire des Pyrénées centrales et s'applique pour certaines périodes aux principales grandes civilisations depuis l'Antiquité jusqu'à l'époque contemporaine. La grille référentielle a été construite à partir de la notion d'idée d'oeuvre de la théorie de l'Institution et de la Fondation de Maurice Hauriou, de la théorie de la tri-fonctionnalité des sociétés indo-européennes de Georges Dumézil développée par Christian Guyonvarc'h, et de celle de la hiérarchie des fonctions de René Guénon. Le rôle de chacune des trois grandes fonctions, la fonction sacerdotale, la fonction politique et militaire, et la fonction de production des biens et des richesses est analysé selon ce modèle depuis leur origine jusqu'à l'époque contemporaine.
 L'étude montre que de nombreuses strates institutionnelles et juridiques anciennes ont perduré bien au delà de la Révolution française, et notre époque contemporaine, avec la domination de la troisième fonction met en danger l'autonomie et l'identité des territoires locaux.
 Compte tenu des limites actuelles des droits locaux, nationaux et internationaux et des modèles économiques existants, il apparaît nécessaire de rétablir la hiérarchie des ordres de réalité et des différentes fonctions.

The thesis aims at showing the role of the three main functions in the genesis of the juridical status of local territories. The research starts with the central Pyrenees and applies for some periods to the main great civilizations since Antiquity up to contemporary times. The referential pattern is constituted with the “idée d'oeuvre” of the theory of the institution and of the foundation of Maurice Hauriou, along with the theory of the tri-functionality of Georges Dumézil developed by Christian Guyonvarc'h, and that of the hierarchy of functions of René Guénon. The role of each of the three main functions of local territories, the sacerdotal function, the political and military function, and the function in charge of production of goods and wealth is analyzed with that pattern since their origin up to present times.
 The study shows that numerous antic institutional and juridical layers have been continuing far after the French Revolution, and our present times, with the preeminence of the third function, puts in danger the autonomy and the identity of local territories.
 As far as the present limits of the local, nationals, and international laws, and of the existing economic systems, are concerned, it appears the necessity of the reestablishment of the hierarchy of the orders of reality and of the different functions.
