Legal challenges relating to the commercial use of outer space, with specific reference to space tourism

AbstractSince the launch of the first artificial satellite, Sputnik 1 in 1957, the outer space arena has evolved to include non-state entities, which are becoming serious participants in outer space activities themselves, including venturing into the space tourism market. Although space tourism is still in its infancy, it is estimated that the number of space tourists will substantially increase within the next few years. As space tourist activities increase, accidents will inevitably occur, which will give rise to legal questions relating to the duty of states to rescue space tourists in distress, and the liability for damages. This contribution points out that the current outer space treaty regime, which focuses on the use of outer space by states, is to a large extent outdated and that it cannot adequately deal with the unique legal challenges presented by the rapidly developing space tourism industry. This situation is exacerbated by the fact that the outer space legal framework is very fragmented -consisting of treaties, UN principles and guidelines, regional regulations and intergovernmental agreements, as well as national guidelines and legislation. In order to ensure that space tourism is indeed to the benefit of all mankind, it is imperative that clear international legal rules relating to space tourism be formulated, where standards are set for the authorisation and supervision of commercial space activities and the interests of states, passengers and private actors are balanced as far as possible. In view of the urgent need to address these legal questions and the consequent lack of time to negotiate a binding legal instrument, it is submitted that, as an interim measure, soft law guidelines should be developed in relation to space tourism in order to provide a framework for the eventual creation of a consolidated and binding legal instrument on all aspects relating to the use and exploration of outer space.

An Air Force History of Space Activities, 1945-1959DEPARTMENT OF THE AIR FORCE WASHINGTON DC HISTORICAL DIV LIAISON OFFICE; Bowen, Lee (1964-08)Covering the efforts of the United States from 1945 to September 1959 to wrestle with the unknown ramifications of space, this history includes both the civilian and military activities. An Air Force History of Space Activities presents a more detailed treatment of information published in 1960 under the title of Threshold of Space, 1945-1959. Other monographs on this subject include The Air Force in Space, 1959-1960, and (in draft) a sequel for fiscal year 1961. The author of this history begins with the work of the early pioneers in rocketry, the first satellite feasibility studies by the military, and the relationship of the ballistic missile to the space vehicle. He reviews the Russian and U.S. space programs between 1945 and 1957, during which efforts were made to create space law and the United States chose to pursue a space-for-peace policy. The conservatism of policy makers raised obstacles, but there were space projects, some of them under the Air Force. After the shock of Sputnik I, the reshaping of policy resulted in the establishment of ARPA in the Department of Defense and NASA as the civilian space agency. The authors tells of ARPA's supremacy over the military services in 1958; its loss of control to NASA in October 1958; NASA's activities from then until July 1959; the position of the Air Force after losing out to both ARPA and NASA; and the Air Force's determination to cooperate with NASA, through research, development, and the use of its facilities. Within the DoD in 1959, authority for space research and development was transferred from ARPA to DDR&E, interservice tension mounted, the Air Force struggled to regain lost projects and objected to Navy's appeal for a military space command, and the tide turned for the Air Force when the Secretary of Defense decided in September to give to it the responsibility for the development and launching of all DoD space boosters and for management of Sentry, Midas, and Discoverer.
Optimizing the Navy's Investment in Space ProfessionalsNAVAL POSTGRADUATE SCHOOL MONTEREY CA; Miller, Clint W (2011-09)The U.S. Navy relies heavily on the capabilities and advantages provided by space assets. Today's Navy would face severe operational challenges without space-based communications and navigation and surveillance capabilities. A small group of space professionals within the Navy diligently works with other organizations and services to ensure these capabilities are continuously available. The origins of the Navy's involvement with space and rocketry dates back to pre-World War II, when rockets for use on aircraft were developed and tested at the U.S Naval Academy. Since then, the Navy has had an undeniable need to ensure that space systems are available to support naval and joint operations. The Navy's collective knowledge of the space enterprise is therefore invaluable to current naval operations and must be preserved. This study is a reassessment of the current Navy Space Cadre construct based on the implementation and effectiveness of the 2004 Naval Space Cadre Human Capital Strategy. Its purpose is to examine current and historical utilization rates of Navy space professionals, compare the Navy space personnel management construct to that of the other services, identify the current challenges and shortcomings of the Navy Space Cadre, and offer reasonable recommendations that could optimize the Navy's investment in space professionals.
