Abstract
Educational law provides information and guidelines concerning the concepts of democracy, freedom, law, and rights as they relate to the education milieu. This article suggests that although Canada recognizes the rights of prisoners and regular school students, their implementation and practice are not directly enforced in relation to education. The article attempts to define rights and discusses the processes for defining prisoners and regular school students. The impact and influences of the authorities governing prisoners and regular school students are examined and those rights granted to prisoners and students in relation to education are presented. The conclusion argues that rights in relation to education for prisoners and students are paid "lip service" in Canada and that the implementation of their rights associated with education is virtually non-existent. RÉSUMÉ Les lois sur l'éducation fournissent des indications et des directives sur les concepts de démocratie, de liberté, de législation et de droits en matière d'éducation. Cet article révèle que même si le Canada reconnaît les droits des prisonniers et des étudiants intégrés dans la vie scolaire normale, il ne les applique nullement dans le domaine de l'éducation. L'article tente de définir ces droits et présente les différents procédés permettant de définir les prisonniers et les étudiants. L'article fait également le point sur les influences des autorités régissant les prisonniers et les étudiants intégrés dans le système scolaire normal de même que sur les droits accordés à ceux ci au chapitre de l'éducation. L'auteur conclut en indiquant que les droits en matière d'éducation pour les prisonniers et les étudiants n'existent que "pour la forme" au Canada et que leur mise en application reste lettre morte.

Export search results
