Abstract
"Durante los últimos años se ha visto una proliferación de diferentes tipos de justicia transicional, los cuales abarcan desde la verdad pura y las fórmulas de reconciliación hasta diversas aproximaciones integradas, combinando juicios internacionales o internacionalizados con formas alternativas de justicia. Muchos de estos fenómenos han sido examinados en estudios de caso individuales; sin embargo, se han hecho pocos intentos por unir las piezas del rompecabezas y analizar los méritos y problemas de las distintas opciones que ofrece la justicia transicional. Este ensayo busca suplir esta deficiencia, estudiando diferentes diseños institucionales de justicia transicional desde una perspectiva comparada basada en el impacto. También pretende identificar algunos de los parámetros contextuales que pueden contribuir al éxito o al fracaso de fórmulas específicas de diseño institucional. Más aún, esta contribución busca enfatizar que los modelos de justicia internacional y nacional no son contradictorios sino, más bien, fuerzas interdependientes en el proceso de una construcción de paz sostenible, en áreas tales como los juicios criminales, la protección y la reparación de las víctimas. El escrito plantea que la justicia transicional requiere de acercamientos pluralistas y complementarios combinando mecanismos paralelos, tanto a nivel doméstico como internacional, con el fin de triunfar en la práctica, especialmente luego de que la Corte Penal Internacional haya entrado a operar" ["Over the past few years have seen a proliferation of different types of transitional justice, which range from the pure truth and reconciliation formulas to various integrated approaches , combining international or internationalized trials with alternative forms of justice . Many of these phenomena have been examined in individual case studies , but there have been few attempts to piece together the puzzle and discuss the merits and problems of the various options offered transitional justice. This paper seeks to fill this gap by studying different institutional designs of transitional justice from a comparative perspective based on impact. It also aims to identify some of the contextual parameters that can contribute to the success or failure of specific formulas of institutional design. Moreover, this contribution seeks to emphasize that patterns of international and national justice are not contradictory but rather interdependent forces in the process of building sustainable peace in areas such as criminal trials , protection and repair of victims . The brief argues that transitional justice requires pluralistic approaches combining parallel and complementary mechanisms, both domestically and internationally , in order to succeed in practice, especially after the International Criminal Court has come to operate"]
