Abstract
"El objetivo de este documento es analizar la situación de los derechos humanos de las mujeres migrantes de América Latina y el Caribe, identificando sus principales problemáticas, los instrumentos jurídicos internacionales para su promoción y protección, y los desafíos pendientes para lograr que la población migrante pueda efectivamente vivir con dignidad sus libertades fundamentales. El primer capítulo analiza el estado de avance de los instrumentos jurídicos internacionales en favor de los derechos humanos de las mujeres migrantes, destacando, en perspectiva histórica, los debates y principales acuerdos consolidados en el Sistema de las Naciones Unidas. El segundo examina la tendencia actual de la migración de mujeres de América Latina y el Caribe, tanto en los flujos intrarregionales y hacia los Estados Unidos como en los extrarregionales, en particular, hacia España y Japón. Los siguientes capítulos presentan algunas de las principales problemáticas que afrontan las mujeres migrantes en su aventura transfronteriza: el servicio doméstico como principal acceso al mercado laboral de los países de acogida, la precaria situación de su salud sexual y reproductiva y la trata de personas como una de las violaciones más graves de sus derechos humanos. Finalmente, se recogen las principales conclusiones del estudio y se presentan algunas recomendaciones de política para consolidar la gobernabilidad democrática del proceso migratorio en la región". ["The aim of this paper is to analyze the situation of human rights of migrant women from Latin America and the Caribbean , identifying their main problems , international legal instruments for the promotion and protection , and the challenges to achieve the migrant population can actually live with dignity fundamental freedoms. The first chapter discusses the progress of international legal instruments for human rights of migrant women , highlighting , in historical perspective, the main debates and agreements bound in the United Nations System . The second examines the current trend of migration of women in Latin America and the Caribbean, both intraregional flows and from the United States and outside the region , particularly to Spain and Japan. The following chapters present some of the main problems facing migrant women in their cross-border adventure : domestic service as the main access to the labor market of the host countries , the precarious situation of sexual and reproductive health and human trafficking as one of the most serious violations of their human rights. Finally, the main conclusions of the study are collected and some policy recommendations are presented to consolidate democratic governance of migration in the region".]
