Abstract
"Este artigo teve como escopo analisar a esterilização compulsória de pessoa com deficiência intelectual à luz do princípio da dignidade humana, mais precisamente com base em um de seus elementos, a autonomia. Objetivou-se, ainda, neste artigo, examinar o dispositivo da Lei n. 9.263, de 23 de janeiro de 1996, que versa sobre o planejamento familiar e a esterilização voluntária e involuntária. Sendo assim, esta investigação, baseada em revisão de literatura e no emprego de método dedutivo, adotou como passos metodológicos: a demarcação conceitual do princípio da dignidade humana, e, especificamente, do princípio da autonomia. Num segundo momento, o objeto de análise foi a Lei de planejamento familiar e seu preceito acerca da esterilização mediante autorização judicial visando delimitar seu âmbito de atuação e requisitos de aplicação. E, por fim, aplicaram-se os fundamentos teóricos desenvolvidos nos itens iniciais a caso específico com vistas a verificar sua compatibilidade com o princípio da dignidade da pessoa humana e, particularmente, com o marco legislativo pátrio. Concluiu-se que a esterilização compulsória viola o princípio da dignidade humana, uma vez que não respeita a autonomia do paciente e a trata como mero objeto" ["This article aims to analyze the scope of compulsory sterilization of people having intellectual disabilities under the principle of human dignity, more precisely on the basis of one of its elements, namely, autonomy. This article intends to examine the dispositions of Law No. 9263 of January 23, 1996, which deals with family planning and voluntary and involuntary sterilization. Thus, this research has adopted as methodological steps: a conceptual demarcation of the principle of human dignity, and, specifically, the principle of autonomy; as a second step, the object of analysis was the Law on family planning and sterilization and the legal authorization aiming at delimiting its scope and its application requirements; and, finally, the application of theoretical foundations developed in the first moments to a specific case aiming to verify its compatibility with the principle of human dignity and particularly with the national legislative framework. We concluded that compulsory sterilization violates the principle of human dignity, because it does not respect patients’ autonomy and deals with them as mere objects"]
