Abstract

"O presente artigo tem por objetivo estudar a evolução do conceito de família na modernidade e suas configurações atuais, estabelecendo reflexões acerca da instituição recente da Guarda Compartilhada. A guarda de filhos foi modificada pelo decreto presidencial de 13 de junho de 2008, determinando preferencialmente o compartilhamento da guarda dos filhos havidos no casamento de pais que se separam. Concluindo, o artigo tece algumas reflexões bioéticas acerca da família como instituição primeira da nossa humanidade, considerando os aspectos e dilemas da sobrevivência da nossa espécie no planeta" ["The present article aims to study the evolution of the concept of family in modernity and its configurations, establishing reflections concerning the recent institution of Shared Care. The custody of children was modified by a Law of June 13, 2008, determining the preference for shared care of children in cases of divorce.
