Abstract
"Si d’évidence, il y a un grand intérêt, voire une urgence certaine, à rechercher le meilleur bénéfice que les pays en développement pourraient tirer de la mise en oeuvre des biotechnologies, le rapport de celles-ci au droit, et encore plus à l’intervention du juge, n’apparaît pas, à premier abord, comme la méthode la plus sûre de contribuer au sursaut économique de ces pays. C’est toutefois oublier que le développement des biotechnologies, dont on nous demande d’envisager les effets et même les bienfaits pour les pays en développement à l’horizon 2010, ne peut prendre sens que dans une démarche de développement solidaire qui, outre un volet de coopération technique et économique, comprend nécessairement une dimension politique et morale. S’il convient donc d’être prudent sur les effets du facteur économique et répondre avec Andromaque «Seigneur, tant de prudence entraîne trop de soin.Je ne sais pas prévoir les malheurs de si loin», il convient, tout autant, d’affirmer avec résolution, s’agissant de notre volonté de combattre le sous-développement, que la question est hautement opportune, que le droit peut contribuer aux solutions à y apporter et que le juge a pleinement sa place dans ce combat" ["If it is obviously very interesting and even unquestionably urgent to aim at the best benefits developing countries could draw from the implementation of biotechnologies, the relationship of those with right, and even more with the intervention of judges does not seem at first glance the surest method for contributing to the economic boost of these countries. However this implies forgetting that the development of biotechnologies, whose effects and even benefits for the developing countries in 2010 we are required to consider may only have sense inside solidary development which, in addition to technical and economic collaboration, involves necessarily a political and moral dimension. If it is thus advisable to be careful regarding the effects of economic factors and to answer, with Andromache “Lord, so great a prudence involves too much care. I cannot envisage misfortunes for such a distant time”, it is also vital to affirm with resolution, as regards our will to fight underdevelopment, that this is a highly opportune question and also that right may contribute to find solutions and that the judge has a full place in this combat"]
