Abstract
"O Direito e a Bioética se vêem frequentemente diante da dificuldade de buscar e fazer a justiça, quando, por exemplo, há recursos limitados para atender as necessidades ilimitadas, situação assaz comum na assistência à saúde. Nesse sentido, o texto discute questões relativas à ideia de justiça na alocação de recursos em saúde, como: é a justiça o mesmo que igualdade? Mas igualdade de quê? Quais os critérios para se promover uma alocação de recursos escassos de forma justa e equitativa, quando eles não são suficientes para todos, em que pese o direito universal à saúde? Embora não se tenha a pretensão de uma resposta definitiva para questões tão milenares, a discussão da matéria se revela útil como auxílio para a busca de uma melhor distribuição de recursos, sob a realidade da escassez nas chamadas escolhas trágicas em saúde" ["The law and bioethics are often faced with difficulties in seeking and doing justice when, for example there are limited resources for attending to unlimited needs, which is a fairly common situation in healthcare. In this regard, the text discusses issues relating to the idea of justice in allocating healthcare resources, such as: Is justice the same as equality? But equality of what? What are the criteria for promoting allocation of scarce resources justly and equitably, when they are insufficient for everyone, notwithstanding the universal right to healthcare? Although this paper makes no claims to provide a definitive answer for such longstanding questions, discussion of this issue is shown to be useful as an aid for seeking better resource distribution, in the light of the reality of shortages relating to the so-called tragic choices within healthcare"]
