Abstract

"Elaborar un Código penal, es a veces más difícil que elaborar una Constitución, no sólo en Argentina sino en todo el mundo. Alemania tardó, cuando se constituyó la República Federal en el ‘49, veinticuatro años en tener un nuevo Código. Italia todavía tiene el Código fascista, todo emparchado pero tiene el Código fascista. España tardó muchos años también. Francia tardó casi ciento ochenta años en cambiar el Código de Napoleón que lo tenía todo emparchado, etcétera. En nuestro país, los dos Códigos que hemos tenido tuvieron una gestación política larga. Ahora, lo que pasó con el Código del ’21 es que tiene novecientas reformas de las cuales la última brutal fue la de Blumberg, y además se fue multiplicando la legislación penal especial.
