El paradigma bioético y biojurídico relacionado a la transfusión urgente en el paciente testigo de Jehová [Bioethical and legal paradigm bio related to the urgent transfusion in the Jehovah's Witness patient]

Abstract

"En esta investigación se analiza el conflicto desde la perspectiva paradigmática de la bioética y la biojurídica, relacionado con el rechazo por parte de los Testigos de Jehová de recibir transfusiones a pesar de situaciones medicas extrema que pueden atentar contra su vida, basadas en su interpretación bíblica de un mandato explícito de Dios consagrado en las sagradas escrituras, como recurso terapéutico, lo que ha llevado a situaciones conflictivas ético-médico-legales en la relación médico-paciente-familia, que aún no tienen una solución precisa y adecuada, produciendo un gran dilema, debido al choque entre los valores del paciente y los principios de responsabilidad profesional al momento de tener que tomar decisiones, al respecto en tan compleja circunstancia donde se estrechan los limite que signifiquen la diferencia entre sobrevivir o morir. Se hace un análisis reflexivo sobre las implicaciones médico-ético-legales, así mismo las implicaciones legales y jurisprudenciales en el ordenamiento jurídico nacional como internacional de los pacientes Testigo de Jehová que no aceptan como medida terapéutica el ser transfundido, en situaciones urgentes cuando la posibilidad de muerte es elevada si el paciente no es transfundido. Lo que desencadena una situación conflictiva entre dos valores ético-jurídicos fundamentales, como son el derecho a la vida y el principio de autonomía, situación que no ha sido resuelta ni por el ejercicio de la práctica médica, ni por la legislación concretamente" ["In this research the conflict is analyzed from the paradigmatic perspective of bioethics and Biojuristic, related to the refusal of Jehovah's Witnesses receiving transfusions despite extreme medical situations that may threaten your life, based on their biblical interpretation an explicit command of God embodied in the sacred writings, as a therapeutic resource, which has led to legal, medical and ethical conflicts in the doctor-patient-family, which do not yet have a precise and appropriate solution ratio, producing a large dilemma because of the clash between the patient's values and principles of professional responsibility when having to make decisions in this regard in such complex circumstances where the limit that mean the difference between surviving or dying narrow.
