"La “gobernanza” es presentada como un modelo de gestión horizontal basado en la co-responsabilidad entre el gobierno y las organizaciones privadas y sociales. En el presente trabajo propongo desenmascarar dicho concepto a través de un análisis histórico-conceptual (Parte I) y normativo (Parte II). En tercer lugar, a modo de ejemplo, estudiaré la “gobernanza en salud” (Parte III). Mi hipótesis general es la siguiente: bajo el discurso globalizado de la gobernanza se esconde el recurrente ataque neoliberal al Estado de Bienestar, promoviendo un modelo de eficacia que reduzca el poder del Estado distributivo a Estado mínimo, y generando mayor desigualdad por asimetrías de poder" ["The “governance” is presented as a model of horizontal management based on the co-responsibility between the government and the private and social organizations. In the present work I propose to unmask the above mentioned concept across a historical-conceptual analysis (I) and normative (II). Corporate Governance Reforms in NigeriaAdelaja Adekoya, Ayodele (Victoria University, 2011-04)This paper examines the challenges to corporate governance reforms in Nigeria from the promulgation of the Corporate and Allied Matters Act of 1990, the introduction of the 2003 Security and Exchange Commission (SEC) code of best practices in corporate governance to the 2006 Central Bank of Nigeria(CBN) code of corporate governance for banks in Nigeria. It uses related literature to review and discuss the identified challenges. It discovers that some of the challenges to corporate governance reforms in Nigeria stem from the country’s culture of institutionalized corruption and political patronage which is characterized by weak regulatory frameworks and refusal of government agencies to enforce and monitor compliance. The complexity of these challenges are compounded by the wide spread poverty and high unemployment which discourages a culture of whistle blowing. A set of suggested solutions were made including the separation of business from politics, the establishment of a special corporate affairs tribunals within the judiciary to try violators, promoting the culture of whistle blowing, enhancing business through moral education and promoting resource based development through fiscal federalism.

Legal Pluralism and Land Administration in West SumatraTegnan, Hilaire (Eubios Ethics Institute, 2015)"Land administration has always been a delicate issue in the history of nations, and Indonesia, a country where a significant number of the population lives a pastoral life is not exempt from this reality. This paper discusses land tenure issues in West Sumatra, an Indonesian province which is home to the Minangkabau people with their long existing village management system known as Nagari, established to settle disputes based on adat (custom) principles as well as to protect the rights of the community members. These rights include communal land (referred to as tanahulayat hereafter). Long before the Dutch occupation of Indonesian archipelago, the nagari government was vested with powers to regulate communal land in West Sumatra. However, this authority was constantly overlooked by the then Dutch colonial administration as well as the post independence governments (both central and regional). To reinforce the Nagari government as the guardian of the customary law (hukumadat) and to specify its jurisdiction, the Regional Government of West Sumatra enacted two laws between 2000 and 2008: Law No. 9/2000 repealed by Law No. 2/2007 and Law No. 6/2008 on communal land tenure. Although these two laws provide legal grounds to address land issues across the region, land conflicts still prevail in West Sumatra due to negligence of customary law, unkept promises as well as unsynchronized and contradictory regulations. The protests against the local army (Korem) in Nagari Kapalo Hilalang, against the oil palm company in Nagari Kinali, and against a cement factory in Nagari Lubuk Kilangan are cited in this paper as case references.
