Abstract
This paper attempts to critically analyze the issue of Capital Punishment in Indonesia by using a normative juridical approach. It is concluded that its implementation of capital punishment both in Islamic and Indonesian criminal law is carefully applied and with the limits prescribed by law. Such restrictions are expected to balance the views between the pro and against capital punishment in Indonesia. The death penalty in Islamic criminal law is to protect religion, life, property, intellect and descendant. These five basics of human rights are given by the Almighty God that should be protected, the violator of which is liable for capital punishment.
