Abstract
This article examines the Islamic marriage law on CEDAW (Convention on the Elimination of all Forms of Discrimination against Women) perspective. After describing the Indonesian Marital Act, this article also describes the relationship between CEDAW and family problem, the position of men and women in Islam, and to analyze the marital act in Indonesian on CEDAW perspective as well. CEDAW is the convention which is issued by the United Nation commission about woman status. CEDAW has three principles: equality, non-discrimination, and the state obligation to ensure the equality between men and women. The principles are relevant to Islamic teaching principles on the Koran on equality of men and women status. On the other hand, the Indonesian marital act grows and finally finds its maturity on the shape of marital act and Islamic law compilation. On their old ages, some people have been examined the Indonesian family law from many perspectives. Some of them agree to defend and the others want to renew this marital act because they think that it is discrimination.
