Abstract
"É necessário o esclarecimento da experiência do direito como (um) modo de ser-pensar do homem. A investigação da realização do direito alinhado a partir da tutela da dignidade humana é enfrentada pela reconstrução fenomenológica. Daí a necessidade de compreender o Direito a partir do ser-no-mundo. Esta abordagem permite aprofundar um certo ponto de vista fenomenológico, de que o ser do homem (pessoa) está em jogo no seu existir, permitindo vislumbrar mais nitidamente a sua relação com o direito. Especialmente interessante é refletir o direito compreendido a partir do homem (pessoa) em seu próprio acontecer, historicamente situado. É na medida em que o ser-aí humano existe como fundamento do direito – e somente nesta medida -, é que o julgador poderá compreender a questão prévia do ordenamento jurídico pautado nos elementos da historicidade, mundanidade e personalisticidade" ["It is necessary to clarify the right experience as a (one) way of being-thinking man. The investigation of the realization of the right line from the protection of human dignity is facing the phenomenological reconstruction. Hence the need to understand the law from being in the world. This approach allows to deepen a certain phenomenological point of view, that the being of man (person) is at stake in their existence, allowing a glimpse more clearly its relationship with the law. Especially interesting is to reflect the duty ranging from man (person) in their own place, historically situated. It is in that human being-there exists as the foundation of law - and only to that extent - is that the judge may understand the plea of law ruled on the elements of historicity, worldliness and personalisticidade"]
