Abstract
"O presente artigo tem por objetivo investigar o problema: “o que torna possível que a divergência entre os juristas com relação aos fundamentos do direito não seja perceptível?”. Para responder à questão, primeiramente será apresentado um julgamento realizado pelo Supremo Tribunal Federal como um exemplo de divergência comumente suscitada entre os juristas. A partir desse caso mostrar-se-á a, com base no pensamento de Ronald Dworkin, que os diferentes posicionamentos acerca do que o direito diz sobre um caso determinado, na verdade são divergências com relação aos fundamentos do direito, isto é, dizem respeito àquilo que o direito é. Por fim, utilizando a analítica existencial do ser-aí desenvolvida por Martin Heidegger, se buscará encontrar uma resposta para o problema por meio de uma radicalização das ideias do direito como ciência e prática argumentativa" ["This paper aims to investigate the following problem: “What makes it possible that jurists do not recognize their own divergence regarding the fundamentals of law?” .To answer that question, firstly a judgment carried out the Brazilian Supreme Court is presented as an example of a common disagreement occurring among jurists. This case, based on Ronald Dworkin’s thought, demonstrates that the differing views among jurists in a specific case are, in fact, divergences regarding the fundamentals of law, in other words, about what the law is. Finally, the existential analytic of Dasein, developed by Martin Heidegger, is used to find a solution to the problem through a radicalization of the ideas of law as science and as argumentative practice"]
