Abstract
"O princípio da obrigação de motivação das decisões judiciais como garantia fundamental do cidadão tem história recente no Direito pátrio, datando especificamente de 1988, com a promulgação da Constituição da República Federativa do Brasil, em seu art. 93, IX. A realidade não significa, todavia, que os juízes, antes da promulgação do texto constitucional, detinham a escusa de apontar as razões que consubstanciavam suas decisões; é de longo tempo que se impõe ao magistrado justificar seu posicionamento a respeito do caso sub judice, podendo se anotar que desde o Código Filipino, vigente na primeira quadra do séc. XIX, até o Regulamento de nº 737 de 1850, passando ainda pelos códigos de processo estaduais e o código de processo civil de 1939, observava-se a obrigação de fundamentar as decisões judiciais" ["The principle of the obligation of motivation of judicial decisions as collateral fundamental citizen has recent history on the paternal law, specifically dating back to 1988 with the promulgation of the Constitution of the Federative Republic of Brazil, in his art. 93 IX.
