Abstract
"Conectar o Direito à Hermenêutica ou falar de um construtivismo jurídico a partir do real plural e polissêmico é afirmar a fundamentação especulativa do Direito que conduz o jurista à plausibilidade dialógica; é atestar a necessidade e a urgência de um “jus” com abertura intrínseca, universal e infinita, articulada com a linguagem, dentro de uma estrutura racional que comporta a alteridade como parte integrante, substancial e imprescindível. A inteligibilidade da linguagem e da realidade são princípios compatíveis, desde a Idade Média, e desaguam, hoje, no agir comunicativo, ou no princípio dialógico da intercomunicação viva e vivenciada, que encontra no Direito, a sua extensão social. A linguagem, sempre plural e polissêmica que se autoapresenta, que se autojustifica e se autointerpreta, confirma a necessidade de uma hermenêutica à sua base, enquanto atesta a existência de uma pluralidade de formas no que concerne à inteligibilidade do real, da qual o Direito é a expressão no âmbito e no plano do legal-ilegal. Expressar a conexão epistemológica entre Direito e Linguagem é propugnar uma estética hermenêutica para o Direito, ou seja, é formular um Direito a partir de contextos que funcionam como o “approach” histórico e experencial “humus” para a ortopraxia do legal-real" ["Connect the Right to Hermeneutics or speak to a legal constructivism from the actual plural and polysemic state is speculative reasons of law which leads the lawyer to dialogue plausibility; It is to certify the need and urgency of a "jus" with intrinsic opening, universal and infinite, combined with the language within a rational framework that includes the otherness as an integral part, substantial and essential.
