Abstract

" A eficácia de uma norma na ordem jurídica interna é garantida pela existência de um controle jurisdicional capaz de resguardar seu cumprimento. O sistema se sustenta, na verdade, quando garante a aplicação das regras instituídas por meio de sanções capazes de coibir seu descumprimento. Na ordem jurídica internacional, a eficácia da norma raramente é garantida pela possibilidade de aplicação de sanções e decorre normalmente do próprio interesse do Estado em seu cumprimento. Nesse sentido, ACCIOLY (1972:129) ressalta que "o respeito aos compromissos assumidos e, portanto, aos tratados é ponto fundamental do direito das gentes" e que "a principal garantia da execução das cláusulas de um ajuste internacional reside na palavra empenhada por cada uma das partes contratantes"" ["The effectiveness of a standard in the domestic legal order is guaranteed by the existence of a jurisdictional control able to safeguard compliance. The system is based, in fact, when it guarantees the application of rules laid down by means of sanctions able to deter noncompliance. In international law, the effectiveness of the standard is rarely guaranteed by sanctions and proceeds normally own the state's interest in compliance.
