Abstract
"De uma perspectiva histórico-filosófica, é colocada a questão do direito natural no debate que se deu, principalmente, nos séculos XVI e XVII, ocasionado pela descoberta do Novo Mundo e dos índios – destacando, aí, o reconhecimento que eles tiveram como homens e, assim, a defesa dos seus direitos inerentes. Destacam-se, no debate, os defensores da phýsei doulós aristotélica (Juan de Quevedo, Johannes Major, Ginés de Sepúlveda) e os defensores dos direitos dos índios (Bartolomé de las Casas, Domingos de Soto, Francisco de Vitoria). Por fim, e de modo breve, faz-se uma leitura das obras essenciais de Las Casas e Francisco de Vitoria, no que dizem respeito à temática do direito natural e das gentes – considerados por alguns como os germes dos atuais Direitos Humanos" ["From a historical-philosophical perspective, it is placed the issue of natural law in the debate which took place mainly in the sixteenth and seventeenth centuries, caused by the discovery of the New World and the Indians - highlighting, then, the recognition they had as men and thus the defense of their inherent rights. Stand out in the debate the advocates of Aristotelian physei Doulos (Juan de Quevedo, Johannes Major, Ginés de Sepúlveda) and the defenders of indigenous rights (Bartolomé de las Casas, Domingo de Soto, Francisco de Vitoria). Finally, and briefly, this article is a reading of the essential works of Las Casas and Francisco de Vitoria, regarding the theme of natural law and the people - considered by some to be the seeds of the current Human Rights"]
