La investigación y experimentación con embriones humanos: aspectos éticos y jurídicos

Abstract

Following the 2005 law project that regulates the assisted reproduction techniques, the present study retakes the ethical and legal debate concerning the admissibility of non- therapeutic genetic manipulation with human embryo. Contrary to the current legislation, the above mentioned project allows the manipulation of human viable embryo, understanding viable as those that would be able to develop as a human being, accordingly to the article 10.1 of the Constitution (STC 212/1996 a sensu contrario). Besides brief reports of the adopted legislated solution taken by some of our neighbouring Countries, we here report the present legislation concerning the matter as well as the one that should soon be replaced. Also, after that the lawfulness of these practices, from the ethical point of view together with the legal rules that approve the protection of human life under the Constitutional system, would be analysed.

A remolque del Proyecto de Ley reguladora de las técnicas de reproducción asistida de 2005 el autor en el presente estudio retoma el debate ético y jurídico sobre la admisibilidad de la manipulación genética no terapéutica en embriones humanos, que, a diferencia de la legislación hoy vigente, el referido Proyecto de Ley autoriza respecto de los embriones viables, es decir, "capaces para desarrollarse hasta dar lugar a un ser humano, a una persona en el fundamental sentido del artículo 10.1 de la Constitución" (STC 212/1996, a sensu contrario). Junto a unos breves apuntes de las soluciones adoptadas por algunas de las legislaciones de los países de nuestro entorno cultural y político, así como de algunos textos supranacionales, se analiza en el trabajo la legislación actualmente en vigor sobre esta materia y la que en un futuro inmediato la sustituirá para, a continuación, examinar la licitud de esas prácticas desde un punto de vista ético y la conformidad de las normas jurídicas que las autorizan con el sistema constitucional de protección de la vida humana.
