La consideración de los aspectos ético-deontológicos implicados ha resultado más incipiente y comienzan gradualmente a integrarse como una dimensión relevante de la práctica profesional. El presente artículo explora las principales tensiones y desafíos para los psicólogos que realizan evaluaciones forenses en esta materia. Se revisa cómo los principios rectores de la bioética se adaptan a la realidad de las evaluaciones forenses que permiten orientar el desarrollo de buenas prácticas en el área.
  • The Effect of Professional Ethics on Organizational Responsibility of Employees by Testing the Mediating Role of Job Enthusiasm and Team Work

    Background and Aim: Professional ethics can be an effective indicator and an important motivational tool in the success of organizations to create excellence, sustainable development, good and healthy competition, reduce conflicts, increase job motivation, create commitment and social responsibility. The aim of this study was to investigate the effect of professional ethics on organizational accountability of employees by testing the mediating role of job enthusiasm and team work among employees of Ardabil University of Medical Sciences Materials and Methods: The present study is applied based on the purpose and based on the type of method, it is descriptive-correlational and in terms of data collection is a survey. The statistical population of this study included all the staff of Ardabil University of Medical Sciences, 290 people. Based on Cochran's formula and using simple random sampling method (without placement), 170 people were selected as the statistical sample of the research to collect data. To collect the data, questionnaires of variables were used, respectively, independent, mediator, which includes professional ethics (Cadozier), job enthusiasm questionnaire (Salonava and Shuffle), team work (Linchoni) and organizational accountability (Bovens). The validity of the questionnaires was confirmed through apparent validity based on the views of experts and specialists and the construct validity was confirmed through factor analysis; The reliability of the questionnaires was also calculated based on Cronbach's alpha coefficient. Data were analyzed using SPSS 24 and Amos 22 statistical software. Findings: The results showed that professional ethics has a positive and significant direct effect on Staff team work (0.67), their accountability (0.59) and on their enthusiasm (0.46) (p <0.01). The direct effect of team work on employee accountability (0.52) is positive and significant. The direct effect of job enthusiasm on employee accountability (0.37) is positive and significant. Team work has an indirect effect on the impact of professional ethics on employee accountability (0.34). Also, job enthusiasm has an indirect effect on the effect of professional ethics on employee accountability (0.17). Ethical Considerations: After explaining the objectives of the study and reassuring the participants about the confidentiality of information and their verbal satisfaction, questionnaires were distributed among the participants.   • On Deontic Truth and Values

    SUMMARY This article analyzes the thesis of ethical relativism, as defended by Alchourrón and Bulygin (1983). These authors offer, on the one hand, a suggestive conception according to which the question “what are our obligations?” is equivalent to thinking about what is to be done; on the other hand, they defend a relativist conception of ethics. They present three objections to constructivist accounts of ethics that are not relativist: a) the argument of the burden of the proof; b) a version of the dilemma of Euthyphro, and c) the argument of particularism. This article presents counterarguments to these objections in the attempt to show that they are not conclusive and that a space therefore remains for objectivity in the normative sphere.
  • L’influence des devoirs déontologiques sur la responsabilité du médecin

    La responsabilité civile médicale, en constante évolution, connait depuis quelques années une période d’influence. Cette influence est liée à la prise en compte jurisprudentielle de règles d’origine privée qui transforment le régime juridique du droit commun de la responsabilité du médecin. En outre, le médecin libéral est soumis à une responsabilité plurale, à la fois civile, pénale et disciplinaire. La thèse porte essentiellement sur l’étude des rapports entre la responsabilité civile du médecin et les règles de déontologie médicale. Il s’agit d’analyser les conséquences d’un manquement au code de déontologie médicale sur la responsabilité du médecin. L’intérêt du sujet est de mettre en évidence les liens existants entre les devoirs déontologiques et la responsabilité civile. A cet effet, l’opportunité du détournement de la finalité de la règle déontologique au profit de la responsabilité civile interroge. L’analyse jurisprudentielle de la responsabilité civile permettra de constater d’une part, que toutes les règles déontologiques n’ont pas vocation à influencer la responsabilité civile médicale et d’autre part, que les liens entre les règles de droit commun de la responsabilité civile et celles de la déontologie médicale sont souvent ponctuels. En effet, tout dépend de la nature de la règle transgressée, de sa valeur juridique, de sa finalité et de son destinataire. Dans ce cas, faire une étude détaillée de l’état de la jurisprudence civile et disciplinaire permet d’apprécier concrètement l’influence de la règle déontologique sur la responsabilité civile du médecin. In fine, distinguer les rapports entre les deux règles permettra de mettre en évidence leur autonomie respective mais également leur finalité communément protégée.
  • Professional ethics in accounting as assessed by managers of economic units

    Purpose: The article aims to determine the degree of use of ethical patterns contained in the Code of Professional Ethics in Accounting by the management of selected economic units representing the following two provinces in Poland: the pomorskie province and the kujawsko-pomorskie province in 2015, 2017 and 2019, as well as to show the factors influencing unethical behaviour. Design/Methodology/Approach: The study analyses the results of the surveys conducted in November and December 2015 in the period from March to May 2017 and in the period from October to December 2019 among 220 heads of economic units operating in two Polish provinces, i.e., the pomorskie and the kujawsko-pomorskie provinces. Findings: The practical application of ethical standards in accounting raises doubts in the opinions expressed by managers of units. Therefore, the role of professional ethics should be strengthened by undertaking various activities to promote, educate, or by taking directly measures to protect and confirm compliance with ethical standards by units. However, the introduction of such solutions requires changes in legal regulations as well as in the way of thinking in all economic entities operating on the market. Practical Implications: Differentiating the ethical certification period from two up to four years depending on the economic and financial situation of the enterprise seems to be justified. Changes and limitations in running a business in selected industries and branches of production dictated by the COVID 19 pandemic may contribute to the use of creative accounting, problems with continuing operations in an unchanged scope and maintaining financial liquidity. Originality/value: The legitimacy and potential organization of ethical certification was verified on a group of people actually working in managerial accounting positions. As part of the survey, managers of economic units were asked how they assess the application of ethical standards in accounting and what the main premises for violating the rules are.
  • “Is this actually a good thing?”: Teacher professional identity and professional ethics under neoliberalism

    This study considers the way teacher professional identity and ethics come into tension with governing policies in education.
 
 Informed by institutional ethnography, the research is a case study of a public secondary school in Sydney, Australia. This case study begins from the standpoint of five teachers, mapping outwards through significant policy texts to the ‘ruling relations’ and discourses that articulate a vision of teacher professionalism in New South Wales. A series of classroom observations contrast these governing discourses with the material reality of the classroom. In this way the design of the study mirrors the tension between neoliberal policy and the practices of teachers as they engage in policy enactment.
 
 Through the course of this research, a mandated professional development process emerged as a significant mode of discursive governance that conceptualises professional identity in particular ways. Reflecting neoliberal accountability approaches as well as diluted goals of ‘equity and excellence’ expressed in Australian education policy, this process purports to define teachers’ work and professionalism. While teachers find the process useful, it contributes to the growth in administrative workload that is emblematic of neoliberalism. This thesis understands policy enactment as involving practices of attachment, aversion, and indifference, designed to mitigate the impacts on teacher workload of new accountability demands and frequent policy changes. However, there is also an excessive and contingent dimension to classroom practice for which teachers must also prepare: something that cannot be captured in policy and paperwork. This dimension demands a strong sense of ethical identity and professionalism; practices that are not privileged in the quantifiable, thinned-out logic of neoliberalism. 
 
 This thesis contributes to ethical and political debates about the nature of teacher professional identity under neoliberalism. It argues that teachers have a role as ‘truth speakers’ as well as an ethical duty of care to help their students prepare for the challenges of a transformed and transforming world. While professional development processes may be helpful in developing some elements of pedagogical and professional practice, this thesis shows that the attitudinal and ethical domains of teacher professional learning deserve a greater emphasis in education policymaking, and teachers deserve greater freedom to strengthen the moral and transformative capabilities of their students.
  • Privacidade e sigilo em deontologia profissional: uma perspectiva no cuidar pediátrico

    A Deontologia Profissional reflecte um conjunto de deveres inerentes ao exercício das profissões de saúde. Profissões organizadas e regulamentadas possuem um código que as orienta no percurso das suas práticas profissionais. A Deontologia garante um bom exercício profissional e, sendo assim, a Deontologia e a Bioética permanecem juntas pois não se podem dissociar tendo em conta o mais elevado potencial profissional. O sigilo profissional e o dever de privacidade são extremamente importantes e são requisitos essenciais na conduta dos profissionais de saúde, principalmente em contexto pediátrico. É absolutamente indiscutível o valor que a criança foi conquistando ao longo destas últimas décadas. A criança tem características muito especiais e, por vezes, torna-se complicado armar a sua autonomia. Cuidar de uma criança, nas diversas fases do seu desenvolvimento, é um desafio para os profissionais de saúde pois requer um esforço constante e respeito por todo o contexto familiar. A criança não pode ser desagregada da sua família em âmbito hospitalar, por isso é importante acolher a família e colocá-la a par dos tratamentos e intervenções. A comunicação pode ser uma importante ferramenta de trabalho onde os valores sociais e éticos poderão ser enaltecidos. A confidencialidade e a privacidade devem ser valores a manter na conduta profissional de acordo com a competência, respeitando a criança e a família.
  • Direito e proteção à privacidade em códigos deontológicos de jornalismo

    A privacidade já não é mais o que era antes. As transformações culturais decorrentes dos avanços tecnológicos mais recentes têm ajudado a redefinir os contornos do mundo reservado da intimidade. Câmeras espalhadas por toda parte, dispositivos móveis cada vez mais populares e capazes de captar qualquer movimento, e sistemas de monitoramento, rastreamento e vigilância massiva fazem com que “estar só” seja quase impossível nos dias atuais. Ao mesmo tempo, bilhões de pessoas exibem-se nas redes sociais e a mídia aperta o cerco para satisfazer o direito à informação. Neste contexto de erosão da vida íntima, avaliamos como o tema da privacidade é tensionado em vinte códigos deontológicos do jornalismo. Analisamos como o assunto é tratado, com que profundidade e que recomendações são dadas aos profissionais para atender a esse direito. Os resultados apontam para superficialidade, desatualização e insuficiência dos códigos para tratar da questão.

    El código de Ética y Deontología del Colegio Médico del Perú debe ser considerado el principal conocimiento de todo médico ya que como es propio del concepto ético nos permitirá decidir y tomar decisiones buenas o malas para poder vivir mejor y hacer vivir mejor de la misma manera en torno a nuestra vida profesional.
 A pesar de tener el Código de Ética y Deontología las violaciones a dicho código son constantes, e incluso están en aumento o son proporcionales al aumento de la población de colegiados médicos por una causa que aún no está claramente determinada.
 La Ética ha sido el fruto de grandes pensadores desde principios de la razón y el desarrollo humano, puede regir y determinar la vida de una persona de acuerdo a como viva entorno a la ética.
 El hecho de tener un Código de Ética y Deontología nos va a ayudar a nuestro manejo profesional y prevenir problemas en torno a nuestro desarrollo laboral. Problemas incluso médico legales, que hoy en día aquejan y pueden llegar a acosar de manera constante al profesional médico.
 Pero qué pasaría si ese instrumento el cual nos ayuda a nuestro desempeño profesional y al cuidado de nuestra labor para con nuestro entorno, ese instrumento que nos va a ayudar a prevenir incluso problemas médico legales cae en el desconocimiento.
 Entonces iniciamos y damos a conocer el trabajo que entregamos a continuación el cual se espera que muestre alguna respuesta que nos ayude a combatir tan pesado problema para lo que es el integro de los colegiados médicos.

  • The reason for having a code of pharmaceutical ethics: Spanish Pharmacists Code of Ethics

    Abstract The pharmacist profession needs its own code of conduct set out in writing to serve as a stimulus to pharmacists in their day-to-day work in the different areas of pharmacy, in conjunction always with each individual pharmacist´s personal commitment to their patients, to other healthcare professionals and to society. An overview is provided of the different codes of ethics for pharmacists on the national and international scale, the most up-to-date code for 2015 being presented as a set of principles which must guide a pharmacutical conduct from the stand point of deliberative judgment. The difference between codes of ethics and codes of practice is discussed. In the era of massive-scale collaboration, this code is a project holding bright prospects for the future. Each individual pharmacutical attitude in practicing their profession must be identified with the pursuit of excellence in their own personal practice for the purpose of achieving the ethical and professional values above and beyond complying with regulations and code of practice.
  • Ética periodística y Covid-19: análisis de contenido de los códigos deontológicos

    Esta investigación realiza un análisis de contenido de 103 códigos de ética periodística de todo el mundo para comprobar su adaptación a las circunstancias derivadas de la pandemia Covid-1٩. A partir de siete recomendaciones formuladas por la Ethical Journalism Network (EJN), se analiza su presencia o ausencia en los códigos. Los resultados muestran una presencia desigual de los principios y diferencias importantes entre los códigos. Ninguno de ellos comprende las siete recomendaciones y solo uno asume seis de ellas. Por el contrario, 17 códigos contienen únicamente una recomendación y dos de ellos no recogen ninguna. Se concluye que las recomendaciones de la EJN más presentes en los códigos se relacionan con principios muy asentados en la ética periodística que dependen habitualmente de la fecha de actualización. Se propone incorporar secciones específicas sobre salud a los códigos.
  • Deontological and Altruistic Guilt Feelings: A Dualistic Thesis

    In this paper we argue in favor of the existence of two different guilt feelings: altruistic guilt (AG) and deontological guilt (DG). AG arises from having harmed, through one's own action or omission, an innocent victim, while DG arises from the transgression of an internalized norm. In most daily experiences of guilt feelings both types are present, but we argue that they are not traceable to each other and that each can be present without the other. We show that the two guilt feelings can be distinguished with reference to behavioral, cognitive, and neurophysiological aspects. Moreover, we demonstrate that they are differently related to other processes and emotions. AG is connected with pain, empathy and ToM. DG is strongly related to disgust. We briefly illustrate some implications for moral psychology and clinical psychology.
  • La “Escuela de la Virtud” del padre Palau como estrategia didáctica para la mejora de la virtud moral y del desempeño ético de los docentes tutores de las asignaturas de Ética y Deontología profesional de la Universidad Católica Los Ángeles De Chimbote – 2015

    Este trabajo de investigación, de tipo explicativo pre-experimental y de nivel cuantitativo, se realizó para determinar si la estrategia didáctica de la “Escuela de la Virtud” mejora la Virtud moral y el Desempeño ético de los docentes tutores de las asignaturas de Ética y Deontología profesional de ULADECH Católica 2015. La muestra estuvo constituida por 20 docentes. Los resultados evidencian una mejora del 5% en el nivel de logro de la virtud moral y un 15% en el desempeño ético. Las conclusiones son positivas pues se logró el diseño y la implementación satisfactoria de una estrategia didáctica para la mejora de la virtud moral y del desempeño ético docente basada en las recomendaciones didácticas de la “Escuela de la Virtud” del Padre Palau, teniendo como participantes a los docentes de las asignaturas de Ética y Deontología profesional de ULADECH Católica. Asimismo, se logró determinar su nivel de Virtud moral y de Desempeño ético, evidenciando un incremento positivo dado que el 100% de los participantes alcanzó el nivel de logro excelente. Por tanto, se considera válida y vigente la propuesta de la “Escuela de la Virtud” del Padre Palau como estrategia didáctica para la actual situación social, eclesial y educativa universitaria.
  • Deontologia e capitalização simbólica na advocacia portuguesa contemporânea

    Partindo de um estudo sobre os jovens que ingressam na advocacia portuguesa, este artigo retoma uma temática bastante arredada da sociologia contemporânea - a ético-deontologia dos grupos profissionais. Sustenta-se que os argumentos ético-deontológicos conduzem os jovens que acedem à profissão através do protótipo liberal a desenvolverem aspirações compatíveis com o exercício liberal , a avaliarem positivamente a sua situação profissional e a adquirirem capital simbólico, num momento marcado pela ascensão dos jovens colaboradores em grandes sociedades de advogados. O argumentário ético-deontológico faz ainda com que estes últimos, distantes do protótipo liberal, não adquiram uma supremacia simbólica absoluta no interior da profissão.
  • Developing Professional Ethics for Rehabilitation Professionals: A Qualitative Study

    Codes of ethics are a set of moral standards based on a value system widely accepted by members of a profession. In order to choose the right course of action and resolve potential ethical challenges, these codes will need to be developed so that ethical values can be identified and prioritized. Medical ethics covers all areas of medicine, and surely, rehabilitation is not an exception. This study aims to codify the ethics of the rehabilitation profession while considering the cultural and religious issues in Iran. For this purpose, we used a qualitative research method, including literature review, questionnaire, targeted interviews, content analysis, group discussion, and code extraction. The results were categorized into seven sections: “respect and empathy”, “autonomy”, “offering responsible care and reducing suffering”, “doing the right thing”, “beneficence”, “privacy and confidentiality”, and “social responsibility”. The development of ethical codes for rehabilitation determines moral norms in order to protect the rights of people who need rehabilitation services. These codes can also be used as a guide to the ethical challenges of the profession.
