Analisis Hukum Tanggung Jawab Sosial Perusahaan (Corporate Social Responsibility) Terhadap Masyarakat Di Lingkungan Perusahaan (Studi Pada PT. Inalum Asahan)

Abstract

Corporate social responsibility is a legal obligation for companies to spend the social environment of the company. The underlying thought that CSR is considered a business ethics that companies not only have economic obligations but also the obligations of the parties concerned (stakeholders), because the company can not live, operate and profit from the others. Law as the norms of life in society is one of the instruments creating a better business activity. The business (company) and the community should create a harmonious relationship. In addition the company as a legal subject should also be a social creature who pay attention social environment so that the company was not perceived as something strange in the neigh borhood. PT Indonesia Asahan Aluminium (INALUM) is one of the companies operating in the district of coal, which stands 1976, has operated for three decades, so if it is socially appropriate PT INALUM, considering to participate to improve the social and economic welfare of the community about the company , because the company recognizes that the smooth development and successful operation can not be separated from all stakeholders. Plenary Session of the House of Representatives to 32 of the draft Law Company Limited, later reinforced by the decision of the Constitutional Court Number 53/PUU-VI/2008 of Law Number 40 Year 2007 regarding Limited Liability Company, as the elaboration of Article 74 of Company Law, so that the implementation of CSR the legal obligations of each limited liability company in Indonesia, then the government reconcile with the Government Regulation Number 47 Year 2012 About Social and Environmental Responsibility Company Limited, the Indonesian government policy is the cause of CSR is set in Indonesia Regulations Act. PT. INALUM in conducting CSR programs with funds budgeted annually by 5% of corporate profits, which covers areas such as education, community, religious, sports and culture and the environment. To realize the CSR program authorizes the company to one of the divisions under the department of public relations and public relations that CSR is Inalum Smelting Plant (ISP). As for the technical implementation of CSR programs to make the division of territory based on proximity to the area surrounding the company's activities, in this case is divided into two categories, namely local and government. Barriers experienced by the company PT. INALUM in conducting CSR that there are two, namely the resistance of the internal and external corporate internal barriers that often found a leader who is sensitive to the environment and ignore the company's social activities, systems, management, corporate culture, lack of direction from the laws that support the implementation of CSR as well as weak law enforcement in the implementation of CSR. External barriers to the response of the community cares about the conduct and supervision and maintenance of the negative view some people will be the implementation of the CSR.
