Abstract
Türk Milli Eğitiminin Temel İlkeleri, 1973 tarih ve 1739 sayılı Millî Eğitim Temel Kanunu’nun 4 ve 17.Maddeleri arasında yer alan 14 adet eğitim öğretim ilkesidir. Araştırma söz konusu 14 eğitim ilkesine dayanarakaçılan davaları incelemektedir. Danıştay kararları taranarak 1982- 2013 döneminde açılan 24 adet davayaulaşılmıştır. Araştırma sonucunda 10 adet ilkeye 27 kez başvurularak toplam 24 dava açıldığı, 4 ilke hakkında iseaçılan dava bulunmadığı görülmüştür. Araştırma idari mahkeme kararlarıyla Danıştay kararları arasındaki görüşfarklılıklarını ortaya koymaktadır. Diğer yandan benzer sorunlar nedeniyle dava açmak isteyen kişi ve kuruluşlariçin bilgi ve veri toplama problemlerini ortaya koymakta ayrıca ulaştığı sonuçlar bakımından başka araştırmalaraışık tutmaktadır.
Today’s Fundamental Principles of TurkishNational Education are based on fourteen tenets that were designed andlegislated in 1973 numbered 1739 of 4th and 17th clauses of the Basic Law ofNational Education. This study aims to examine the subject matters and realmsof lawsuits brought against adducing these fourteen educational principles. Twenty-fourcases opened between 1982 and 2013 were reached by the records of The StateCouncil. The research figures out that all were brought before the courtreferring 27 times to ten fundamental educational principles and it is observedthat there was no any legal action taken on the grounds of the remaining fourprinciples.  This research unveilsdifferent views between rulings of administrative court and the verdicts of theState Council.  It also aims to shedlight on future studies on the point of outcomes it has produced.
