Relación entre las pruebas y la comprobación de la verdad en el proceso canónicoArroba Conde, Manuel Jesús (DIALNET OAI ArticlesUniversidad Católica de Valencia "San Vicente Mártir", 2012)The article analyses the proofs of the evidence as the instruments to achieve the decision according to the truth, final goal of the proccess. Moreover, it exposes the need of having judicial decisions according to the laws and based on an authentic verification of the facts, in order to be at the level expected by the Church, witness of truth. The objective is showing that there is not any reason not to believe in the Canon Law, for no solemnity has anti-epistemic sense, nor avoid create a right decision based on the facts. It starts with an exposition of the theological reach of truth in the Church, and later analyses the concept of truth from the alethic idea of itself (the correspondence with reality determines the truth or falseness of the phrases that describes it). Continues to present some concepts of the canonical evidence system (Favor Veritatis: absolute truth, relative, objective and procedural truth) to pass to the analysis of the evidence: the rules for his proposal, acceptance, acquisition and valuation. Analyzes, finally, three conclusions about the conditions that should be of a judicial decision up to the mission of the Church.
