La constitución política de colombia de 1991: ¿La constitución de la paz?

Abstract

El presente artículo forma parte del trabajo de investigación �Eficacia de la Constitución Política de Colombia como instrumento para superar el conflicto armado entre el Estado y las FARC-EP: una mirada desde la ética utilitarista� que actualmente se encuentra en revisión; el problema que se pretende resolver está relacionado con la inquietud acerca de si la Constitución de 1991 puede erigirse como instrumento eficaz para superar el conflicto con las FARC, ya no, desde la ideología política -pues se sabe que entre comunismo y capitalismo media un abismo-, sino desde la perspectiva de la ética utilitarista; para resolver esta inquietud se recurrió al análisis correlacional de las variables Constitución y conflicto armado con las FARC encontrándose que entre la Carta de 1991 y los objetivos perseguidos por las FARC son más las coincidencias que los desacuerdos, analizado desde el parámetro de la ética utilitarista, la principal conclusión es que la Constitución de 1991 es un camino posible hacia el bienestar que promete el principio ético utilitarista, y que puede constituirse en un instrumento eficaz para superar el conflicto armado entre el Estado y las FARC, pero lo que ha faltado básicamente es voluntad política para concretar la paz.

This article is part of the research �Effectiveness of the Political Constitution of Colombia as a tool to overcome the armed conflict between the government and the FARC-EP: a view from the utilitarian ethic� which is currently under review, the problem aims to solve is related to concerns about whether the Constitution of 1991 may stand as an effective tool to overcome the conflict with the FARC, and not from political ideology, it is known that between communism and capitalism there is an abyss-but from the perspective of utilitarian ethics, to resolve this concern correlational analysis was used, taking as variables Constitution and armed conflict with the FARC. As a result it was found that between the 1991letter and the objectives pursued by the FARC aremore agreements than disagreements, analyzed from the parameter of utilitarian ethics.The main conclusion is that the Constitution of 1991 is a possible path to wellness that promises the utilitarian ethical principle, which can become as an effective tool to overcome the armed conflict between the government and the FARC, but basically what has been missing is political will to peace.
