Abstract近年来，因为房产开放所引发的宗教房地产纠纷频仍，宗教房地产问题成为当前宗教工作中的热点问题。特别是在维护国内安定稳定的形势下，如何能有效地解决因宗教房地产问题而引发的纠纷，甚至是群体性事件成为地方政府和宗教事务部门的一项新课题。但与这种严峻的形势形成鲜明对比的是，当前有关宗教房地产问题的法律法规较为缺乏，特别是缺少能够真正有效指导解决具体宗教房地产纠纷的可操作性法律规范。 目前，无论是在政府宗教事务部门，还是在理论界，宗教房地产问题已经逐渐引起诸多关注。遗憾的是，由于大部分有关宗教房地产问题的文件并未向社会公开，主要是在政府部门之间流通传阅。使得有关这一方面问题的论述，特别是研究性论述还是比较少见。本文正是从这一角度考虑，试图对当代中国宗教房地产登记管理制度及其存在的问题作一简单的梳理和澄清，一方面试图表明中国房产问题的形成实际上是与近代以来中国朝向现代化的努力分不开，也就是说宗教房地产问题的形成是中国近代历史的产物，它是宗教与近代中国社会之间碰撞和磨合的产物。另一方面本文也试图通过这种论述为现代中国房产问题的理解提供一种语境，通过这种历史延续性的说明，试图表明未来对中国房产问题的解决必需以理解宗教在现代社会中的作用为前提，更重要的是，必需在法律层面为宗教在现代社会的地位做出清晰名曲的定位和说明。 从这种思考出发，本文从宗教房地产登记管理制度的概述、宗教房地产问题的历史形成、福建解决宗教房地产问题的努力三个方面试图阐明我国宗教房地产制度和问题的历史形成、具体内涵和实践上面临的问题。 通过这三个方面的论述，试图阐明，我国当前宗教房地产问题的形成在近代中国社会历史发展史上具有深刻根源，而当前房产问题的解决也不能仅仅依靠零零散散的政策性文件，要想在未来真正有效地解决宗教房地产问题，就必须将宗教房地产问题置于整个中国社会的现代语境中加以理解，要摒弃有关宗教的偏见，并在法律和制度层面上实现这种理念。
