Abstract
Speeches as the next President of the Government against Hispanic minorities in the United States, or speeches of some European political parties of the extreme right against Muslims, show that the issue of “hate speech” is a very current issue. In this article, we carried out a comparative study of the American and the European models, through the study of the jurisprudence of the US Supreme Court and the European Court of Human Rights, in order to extract hermeneutical parameters used to solve conflicts that arise in relation to the limits on freedom of expression.
Discursos como el del próximo presidente del Gobierno contra las minorías hispanas en Estados Unidos, o el de algunos partidos políticos europeos de extrema derecha contra los musulmanes, ponen de manifiesto que la cuestión del discurso del odio está hoy de plena actualidad. En el presente artículo se lleva a cabo un estudio comparativo de los modelos estadounidense y europeo a través del análisis de la jurisprudencia del Tribunal Supremo norteamericano y del Tribunal Europeo de Derechos Humanos con el fin de extraer parámetros hermenéuticos que sirvan para resolver los conflictos que se plantean en relación con los límites a la libertad de expresión.

Export search results
