Abstract
The recent resolution dated February the sixth 2013 by the Supreme Court as an answer to an appeal on a municipal regulation (Ordenanza), and without any meaning of a general response on the question whether in Spain within the frame of the Constitution is or not possible to forbid the use of the full islamic veil in public places like in the case of the French Law, it gives us interesting keys in the debate and legitimacy of it use in different environments, taking into account the possible developments towards the future, always within the framework of human rights and a pluralistic democracy. In any case, it is of utmost relevance to underline in relation with the aforesaid resolution that, for the first time, the Supreme Court embraces the consideration of the use of the full islamic veil as belonging to religious freedom.
El reciente pronunciamiento del Tribunal Supremo en Sentencia de 6 de febrero de 2013, dando respuesta a la impugnación de una concreta Ordenanza municipal y sin tener sentido de respuesta a si en España y en el marco de la Constitución cabe o no una prohibición del uso del velo integral en los espacios públicos al estilo de la Ley francesa, nos proporciona interesantes claves en el debate y la legitimidad de su uso en los diferentes entornos, siendo referencia imprescindible en el posible desarrollo hacia el futuro, que exige tener en cuenta el marco del respeto de los derechos humanos y del sistema de democracia plural. Es también de crucial importancia resaltar su toma de postura en relación al velo integral, presentada por primera vez en un foro decisorio de primer orden, como manifestación de libertad religiosa, (art.16.1 CE).
