Abstract
Until the amendment introduced by Law 30/1982, article 42 of the Spanish Civil Code demanded to Spaniards who got married before a civil authority to prove that they did not profess the Catholic faith. For marriages celebrated abroad, the lack of this requirement implied their non recognition in Spain. After the entry in force of the Constitution of 1978, the Spanish case law had maintained this requirement for marriages celebrated whilst the former article 42 was in force. However, the Spanish Supreme Court has revised its jurisprudence and declared in a recent judgment the supervening unconstitutionality of this article. The aim of this article is to analyze the above mentioned judgment.
Hasta la reforma introducida a través de la Ley 30/1982, el art. 42 del Código Civil exigía que los españoles que se casaran en la forma civil acreditaran su acatolicidad. En el caso de que el matrimonio se hubiera celebrado en el extranjero, la ausencia de este requisito implicaba la denegación del reconocimiento del matrimonio. Tras la entrada en vigor de la Constitución de 1978 la jurisprudencia ha mantenido la vigencia de este requisito para los matrimonios celebrados durante la vigencia del antiguo art. 42 Cc. No obstante, en una reciente sentencia el Tribunal Supremo ha modificado su posición y ha declarado la inconstitucionalidad sobrevenida del precepto al ser contrario a los principios de libertad religiosa e igualdad. El objetivo del presente artículo es analizar la mencionada sentencia.
