Abstract
RésuméLes valeurs et enjeux orientant débats et régulation concernant la prostitution semblent être récurrents. Si de nouvelles problématiques telles que la migration clandestine et la traite des êtres humains, sont venues s’ajouter à d’autres portant davantage sur des questions purement morales, elles se dissimulent autour d’anciennes oppositions : une vision égalitariste visant un traitement universaliste s’opposant à une vision pluraliste de la société et à un traitement particulariste ; la perception de la prostitution comme forme d’exploitation paradigmatique, et donc inacceptable, des femmes versus une perception l’envisageant comme simple miroir des inégalités ; une représentation de la prostituée victime et innocente opposée à celle d’une femme coupable et donc déviante ; enfin la question de la possibilité de vendre son corps s’opposant à l’idée de la vente de services et seulement d’une partie de soi. Cet article traite des enjeux sous-jacents au débat sur la prostitution, ainsi que des formes de régulation qui en découlent au travers d’une perspective historique.
The values and issues shaping either the debates or the regulation of prostitution seem to be recurrent. If new topics, such as irregular migration, smuggling or trafficking in human beings have met others which are more focused on purely moral questions, they are still based on old oppositions : an egalitarian perception (aiming an universalistic treatment) versus a pluralistic perception of society (aiming a particularistic treatment) ; perception of prostitution as a paradigmatic form of exploitation of women and therefore unacceptable versus a perception considering prostitution as a simple mirror of inequalities ; a representation of the prostitute as an innocent victim opposed to the idea of a guilty and deviant woman ; finally the question of the possibility to sell one’s own body opposed to the idea that prostitution is only the sale of services and of a portion of oneself. This article deals with the issues underlying the debate on prostitution and on the following forms of regulation according to an historical perspective.
