Abstract
RésuméA cause du progrès des conditions médicales au Japon, un Code de Déontologie est en cours de préparation. L’Association Médicale du Japon (JMA) a promulgué « la directive sur la déontologie pour le médecin » en 2004. Cependant, cette directive ne pourra peut-être pas prendre effet. La raison en est l’état actuel du groupe professionnel des médecins au Japon. (1) D’abord, au Japon il n’existe pas de groupe de médecins dont l’adhésion serait obligatoire, seulement des groupes d’adhésion facultative. (2) Il n’existe pas de règlement éthique de la profession qui aurait effet légal face à une faute professionnelle de la part d’un médecin au Japon. (3) De surcroît, il n’existe pas d’organisations autonomes au sein du groupe professionnel qui examineraient et imposeraient une sanction disciplinaire au médecin qui commettrait une faute au Japon. Après tout, l’éthique du médecin devrait être du ressort de la conscience de chaque médecin. Alors, comment faire pour résoudre de tels problèmes fondamentaux ? Dans cet article, la situation dans divers pays étrangers est passée en revue comme indication de la future conduite de la profession médicale japonaise. De plus, je présente quelques solutions pour les différents problèmes rencontrés pour satisfaire la déontologie du médecin au Japon.
A code of professional ethics for the physician in Japan is being prepared caused by the progress of the medical conditions. The Japan Medical Association (JMA) enacted “the guideline on professional ethics for the physician” in 2004. However, as for the substantial effect of this guideline, it may not be able to be expected. The present state of the professional group of the physician in Japan can be shown as that reason. (1) First, there is not any physician’s group of the compulsory admission, but only professional ability profit group of the voluntary admission in Japan. (2) There are no ethical regulations of the profession which has legal effect to face in the physician’s misconduct in Japan. (3) In addition, there is not any autonomous organizations inside the professional group which examine and impose disciplinary punishment to the physician who went through misconduct in Japan. After all, the ethics in the physician would be left to each physician’s conscience. Then, how should we do to solve such various fundamental problems? In this paper, the situation in various foreign countries is surveyed as an indication of the Japanese medical profession’s future conduct. Moreover, I present some solutions to the various problems in fulfilling the professional ethics for the physician in Japan.
