[[abstract]]諸如像賴文莉事件或是白玫瑰運動,讓我們看到台灣的刑事司法已進入由大眾情緒主導的年代,這樣的情況也引起不少研究者的注意。只是,面對上述變化,絕大多數的學者抱持著負面的態度,認定不理性的情緒將扭曲理性的法律制度。因而面對大眾情緒主導刑事政策的情況,學者通常試圖在立法程序中阻擋,或盡力在公共論域中挑戰輿論。在過去,我們的確也看到成功的例子,例如:對性侵害犯進行化學去勢或是鞭刑。然而,一旦民怨強烈,可能危及政權時,法律依然朝向大眾情緒轉彎,有時甚至出現爆衝的情況,2010年最高法院針對兒童性侵害案件所做出的那號決議,就是刑事法學界無力面對大眾情緒的最好證明。姑且不說上述將理性與情感二分,認定法律中不存在情感的看法,早已飽受批評,消極地迴避法律中的情感,並不會讓情感對於法律的影響消失。因此正面地面對法律中的情感,對其形成進行意識型態與形成條件的分析,並從其生成條件,找到正向引導(channel)情緒的方式,對當代刑事法學的研究以及政策研擬同時存在意義。
[[abstract]]Various events in recent years show that emotions began to dominate the operation of the criminal justice system in Taiwan. Situations like this have caught the attention of researchers in this field. Nevertheless, the majority of them, who are used to be committed to the ideals of reason and reasonable discourse, tend to have negative opinions of this emotive turn, and thus deny any role for emotions in the criminal justice system. But ignoring and rejecting emotions would not stop their advancement in the criminal justice system. This project argues emotions are already prevalent in law. Instead of ignoring and rejecting emotions, we should try our best to understand how emotions are formed, interpreted, and communicated in the field of criminal justice, so that we could possibly channel them, and use them to back up the moral meanings of punishment.

Export search results
