Відповідність змісту шлюбного договору морально-правовим засадам (замітки до наукової дискусії)

Abstract

У контексті вимог до змісту шлюбного договору досліджується категорія «надзвичайно невигідне матеріальне становище», в результаті чого доведено, що критерієм оцінювання правозгідності умов шлюбного договору є відповідність вимогам справедливості, добросовісності, розумності та моральним засадам суспільства, а нехтування морально-правовими засадами при визначенні умов шлюбного договору зумовлює його оспорюваність.

В контексте требований к содержанию брачного договора исследуется категория «чрезвычайно невыгодное материальное положение», в результате чего доказано, что критерием оценки правосогласности условий брачного договора является соответствие требованиям справедливости, добросовестности, разумности и нравственным началам общества, а пренебрежение нравственно-правовыми началами при определении условий брачного договора обусловлюет его оспоримость.

The violation of the claim about compliance moral principles of the society is stated in the article gives to the sides of the marriage contract (another person whose rights and interests violated by the indicated contract) the possibility to contest it by going to court with the requirement about declaring it non-validity, if you refer to the requirements of Paragraph 5 of Article 97 of Family Code of Ukraine. It is impossible to reach unity of opinions about the definition of meaning concept «extremely disadvantageous financial situation» (Рaragraph 4 of Article 93 of the Family Code of Ukraine) is proved, and attempts of legislative interpretation of such concept conflict with its appointment as the valuation category, which requires an individual approach to each individual situation of life. Both linguistic and legal point of view unreasonably with the term «disadvantageous» to use the term «financial» is proved, therefore to use the formulation «extremely disadvantageous situation» is offered and amend the Рaragraph 4 of Article 93 of the Family Code of Ukraine and do it as follows: «A marriage contract can not reduce the volume of the rights of the child are install by this Code and set up one of the married couple in an extremely disadvantageous situation». Compliance of demands justice, good faith, rationality and moral principles of the society is the criterion of evaluation legitimateness conditions of the marriage contract is proved, and the ignore of moral-legal principles in determining the сonditions of the marriage contract causes its voidable.
