Isto em conseqüência da quantidade de problemas efetivamente verificados em várias partes do mundo. No ensejo destas discussões, acerca dos fundamentos e da efetividade dos Direitos Humanos, o objetivo deste trabalho é problematizar algumas questões que parecem extrapolar o âmbito próprio a tais Direitos. Nosso ponto de partida foi um caso concreto amplamente difundido pela mídia nacional: a libertação, no Estado de Minas Gerais, de condenados ao sistema prisional, sob a alegação de que estariam cumprindo suas penas em condições humanamente deploráveis, e a imediata reação dos meios de comunicação de massas contra a medida. Apesar de ter como pano de fundo este fato concreto, pretende-se discutir a questão dos Direitos Humanos a partir de seus conceitos, conforme legados pela tradição ética, filosófica e jurídica. A questão imediatamente colocada é quanto à validade e à eficácia do conceito em alguns momentos muito específicos. Para tanto o pensamento de Hannah Arendt será de fundamental importância, inclusive pela polêmica que suas análises sobre o tema inauguram e por sua posição, de início, controversa ante aos fatos" ["Under international law the issue of recognition, implementation and maintenance of human rights may be, next to the commercial and warlike negotiations, giving rise to the most controversy. On occasion these discussions about the fundamentals and the effectiveness of Human Rights, the purpose of this paper is to discuss some issues that seem to go beyond the scope itself to such rights. Our starting point was a case widely disseminated by the national media: the liberation, in the state of Minas Gerais, the inmates of the prison system, on the grounds that they were serving sentences in humanly deplorable conditions, and the immediate reaction of the means of mass media against measure. Despite the background of this particular fact, it intends to discuss the issue of human rights from their concepts, as bequeathed by ethical tradition, philosophical and legal. The immediate question raised is as to the validity and concept efficacy in some very specific moments.
