Abstract
"O presente trabalho tem o objetivo de delinear o paralelo entre a efetivação da tutela dos deveres éticos no processo civil e a emergência do Estado Social. Para tanto, conceitua-se o abuso do direito e o abuso do processo; posteriormente, analisa-se a evolução histórica da atuação das partes no processo e algumas implicações relacionadas aos modelos políticos vigentes. Passa-se ao estudo da lealdade processual e do dever correlato de veracidade, observado seu caráter relativo, concluindo sobre a necessidade de encará-los como deveres concretos, e não apenas postulados de recomendação" ["This paper aims to outline the parallel between the effectiveness of protection ethical duties in the civil process and the emergence of the welfare state. To this end, considers it the abuse of rights and abuse of process; subsequently, it analyzes the historical evolution of the performance of the parties and some related implications of prevailing political models. Passes to the study of procedural fairness and the correlative duty of truthfulness, observing their relative character, concluding on the need to view them as specific duties, not just recommending postulates"]
